Javier Pérez Santana has been sentenced to four months in prison and a supervised release measure consisting of the prohibition of approaching within 500 meters of the actress Jedet, and of communicating with her by any means for two years, according to the sentence to which EL PAÍS has had access, in which the producer is convicted of sexual assault. The producer, according to the text, has already compensated Jedet with 1,918.59 euros for the damages caused, and will have to assume the costs of the process. Shortly afterwards, Jedet told the judge that the producer approached her again and rejected her because Pérez Santana insisted with the same phrase about “leaving her out” of his audiovisual productions. “After a longer period of time, the accused approached her again and grabbed her on two occasions by one of her breasts, over her clothes, causing Ms. Izquierdo’s anger, who once again reproached him for her behavior,” the account of the events continues.

The sentence specifies a fourth time in which the filmmaker returned to her, around 5:46 in the morning. “When he saw her reaction, he began to tell her: ‘Shitty travelo, envious transvestite, whore,’ and when Carmen Jedet’s representative invited him to leave there, he refused to do so, while making obscene gestures with his mouth, with Ms. Izquierdo’s companions standing between them, who notified the event’s security personnel, who took the accused away from the place.”

When local security arrived, the actress, as she explained in court, had to go to the bathroom because she was suffering an anxiety attack. After alerting the guards, they also called the National Police who showed up at the event.

The judge also determines that he must sentence Pérez Santana to “special disqualification for the exercise of the right to passive suffrage during the time of the sentence and the accessory of special disqualification for any job or position, paid or not that involves regular and direct contact with minors for two years and six months.”

Pérez Santana’s defense has argued that “he was under the effects of strong alcohol intoxication which, together with the antidepressant medication he was taking, caused his physical and mental faculties to be noticeably altered.” Furthermore, the producer added in his statement that “he had few memories of that night, although he remembered approaching Jedet at the beginning of the party along with his friend Adrián, and noted that he drank a lot of alcohol and was being treated with antidepressants, that he was taking pills because he had buried a close friend three days ago.”

The filmmaker acknowledged that “after these events he has been retired, without having a social life, that he does not have the strength or desire to do anything related to cinema, that he voluntarily entered a clinic for detoxification treatment because what happened seemed shameful to him.” But the judge considers that “it cannot be admitted that there is a complete defense, a total and absolute annulment of conscience and will.”

The judge insists on several occasions in his ruling that Jedet’s statement “has been persistent, coherent and without essential contradictions from the first moment and is, finally, corroborated by the statements of the witnesses.” The actor Pol Montañés and María Sacramento Losada, representative of the actress, testified at the trial and provided evidence such as the recording of the agent’s cell phone in which the humiliating comments towards the artist can be heard, as well as videos from the security cameras in which the violent behavior of the producer against the singer can be seen.

“No spurious motive is identified that could exist in the complaint filed,” writes the magistrate and adds that, among other reasons, Jedet did not know Pérez Santana. Furthermore, everything that happened caused him anxiety problems, which is why he had to stop working from January 30 to March 1, 2023.
